Temporary Event Notice
 
If you wish to hold an event in England or Wales that is not covered under a Premises Licence or a Club Premises Certificate you must give a temporary event notice (TEN) to your local licensing authority no later than ten working days before the event. If the premises where the event is to be held is in areas governed by two or more local authorities applications must be made to each.

Normally most of the activities mentioned below will be covered under a Premises Licence or a Club Premises Certificate; however, a TEN can be used in conjunction with these to cover activities or extend hours which are not permitted by a Licence.

A Permitted Temporary Activity is a Licensable Activity; this includes Regulated Entertainment, Late Night Refreshment and the Sale of Alcohol or the Supply of Alcohol by or on behalf of a Club.

  • Regulated Entertainment includes Performances of Plays, Exhibition of Films, Live Music, Recorded Music, Indoor Sporting Events, Boxing or Wrestling Events, Performances of Dance, Provision of facilities for the above activities.
  • Late night refreshment means the supply of Hot Food and/ or Hot Drink to the public between 2300 - 0500.

Licence Summary
You must give the TEN in writing, in duplicate to the local authority with the fee payable of £21 and you must also give a copy of the notice to the police. All copies must be given no later than ten clear working days before the event. "Clear working days" do not include the date of the event, the date the TEN is received, weekends or bank holidays.

There are restrictions on the use of a TEN, they are:

  • You must be 18 years or older to give a TEN.;
  • No more than 12 TENs per premises per calendar year (1 Jan - 31 Dec);
  • A Non Personal Licence Holder can only give a maximum of 5 TENs;
  • A Personal Licence Holder can give a maximum of 50 TENs in England and Wales;
  • Must not exceed 15 days aggregate over the year;
  • Must not exceed 499 persons on the premises at any one time (this includes any staff);
  • There must be at least 24 hours between two TENs;
  • The maximum period of time a TEN can last for is 96 hours;
  • The notice must be in a specific format.

Application Evaluation Process
The local authority will acknowledge receipt of the notice by sending a notice to the premises user before the end of the first working day it was received, or before the end of the second working day if the day the notice was received was not a working day.

Objections
The chief police officer who receives the notice and believes that the event would undermine crime prevention objectives can serve an objection notice on the licensing authority and the premises user. The notice must be served within 48 hours of receipt of the temporary event notice.

The local licensing authority must hold a hearing if an objection notice is served. They may issue a counter notice if it considers it necessary for the promotion of crime prevention objective. A decision must be made at least 24 hours before the beginning of the event.

A police chief may modify the TEN with the consent of the premises user. In such a case an objection notice will be deemed to have been withdrawn.

Counter notices may be provided by the licensing authority if the number of permitted TENs has been exceeded.

If a licensing authority decides not to issue a counter notice in relation to an objection notice the chief police officer can appeal the decision.

If a counter notice is given in relation to an objection notice the applicant may appeal against the decision. Appeals must be made to the local Magistrates' court within 21 days. An appeal may not be brought later than five working days from the day of the planned event.

It is in the public interest that the authority must process your application before it can be granted. If you have not heard from the local authority within a reasonable period, please contact it. Please contact your local authority in the first instance.
