Individuals: it is an offence to smoke in an enclosed or substantially enclosed public place or workplace. People who break this law by lighting up can be served a £50 Fixed Penalty Notice (£30 if paid within 15 days). If the case goes to court, the fine can rise to up to £200.
Premises: managers or occupiers of a smokefree premises or vehicle(s) can be awarded a Fixed Penalty Notice of £200 (or £150 if paid in 15 days) if they fail to display the correct 'No Smoking' signs. If the case goes to court, the maximum fine is £1000.
Management: those who have management responsiblities or control of smoke-free premises and / or vehicle(s) are at risk of a court summons (with a maximum fine of £2500) if they fail to prevent people smoking.
Litter: it is anticipated that people will go outside to smoke: if cigarette stubs, matches and other smoke-related materials are not disposed of properly, this would be detrimental to the environment. It is also an offence to drop litter on public or private land and if caught can lead to a fixed penalty notice and fine of £80.
