What Premises are Smoke-free?

Virtually all enclosed & substantially enclosed public places (eg cinemas, pubs, village halls) and workplaces (including offices, shops, factories etc) are required to be smokefree.

Enclosed = Has a roof and is wholly enclosed either on a permanent or temporary basis

Substantially Enclosed = Has a roof and openings in the walls that represent less than 50% of the total wall area (known as the 50% rule).

Vehicles
All public transport and vehicles used for work purposes have to remain smokefree at all times. All smokefree vehicles are required to display the No Smoking symbol in a prominent position.

Exemptions
There are very few exemptions permitted by the smokefree legislation. They include:

  • Private dwellings
  • Sleeping accomodation for guests & club members
  • Other resedential accomodation eg hospices (although all common parts must remain smokefree)
