Following the issue of Statutory Instrument 2005 No. 1515 - The Re-use of Public Sector Information Regulations 2005 (PSI), Maldon District Council has a commitment to make information available to support and stimulate economic activity where possible.
The Regulations, enacting EU Directive on the Re-use of Public Sector Information aim to establish access to information on the basis of:
- Openness - that the organisation maximises the information available for re-use;
- Transparency - that the organisation has clear and simple policies and procedures;
- Fairness - that all customers are treated the same;
- Compliance - that the organisation has procedures and policies in place to enable them to comply with the first three principles;
- Challenge - that the organisation has a robust complaints procedure.

1. What is re-use?
Information is produced by the Council to support its "public task". Re-use occurs in using that information for a purpose other than that for which it was originally produced. Use of information for private study or non-commercial research is not considered re-use by Maldon District Council.

2. How do I gain access to Information?
Your right to gain access to information is not part of these regulations. There are three laws that give you your right to know.
- The Data Protection Act 1998 gives you the right to see information we hold about you.
- The Freedom of Information Act 2000 gives you the right to access information we publish and other information we hold.
- The Environmental Information Regulations 1992 gives you access to information held by us relating to the state of water, air animals and plants.

3. What information will be available for re-use under the regulations?
The Council will normally make the following available for re-use: -
- information listed on the Freedom of Information list of published documents
- information already publicly available, for example on our website.
The Council will NOT normally release information for re-use where: -
- the Council does not own the Intellectual Property Rights
- where exemptions apply under the Freedom of Information Act, Data Protection or Environmental Information Regulations
- where the information is work in progress
You may request information in a particular format, but there may be an additional charge.

5. How do I apply for permission to re-use information?
Once you have access to the information (you can use your right to know under the Freedom of Information Act) you can then apply to re-use it.
Applications must be in writing stating your name and address, the details of the document (or information) you are applying to re-use, and the purpose for which you want to re-use the information. Send your application to: Re-use of Public Sector Information Maldon District Council Council Offices Princes Road Maldon Essex CM9 5DL.
Your application will be processed within 20 working days. We will provide either a final offer of conditions for reuse or an explanation of our refusal. Occasionally applications may take longer to process, in which case you will be informed of any likely delay.

6. How much will it cost?
Three levels of licence are possible:
- re-use with no restrictions
- re-use under licence with no charge
- re-use under licence with charge
Charges cover basic costs relating to:
- cost of conversion to a different format
- cost of collection, production, reproduction and dissemination
- may include some element of reasonable return on investment
Full charges apply to information or data where Maldon District Council has determined some attempt should be made to recover a return on investment, for example, if there is significant professional or technical input beyond the simple collection and collation of information.

8. What steps do I take if I am not satisfied with your decision or any aspect of the process?
You can complain using the Council's Corporate Complaints Procedure. If you are not satisfied with the outcome of this process you can refer your complaint to:
