Obligations for Licensees

Licences to use the pontoon will only be considered for commercial vessels providing a leisure service on the River Crouch. They are usually awarded on a 12 month basis from 1 April to 31 March and each vessel that uses the pontoon will require its own individual licence.

Licensee's Obligations 

The Licensee agrees and undertakes:

  1. to provide evidence to the Licensor of the following insurance for any vessel using the Pontoon
    • Public Liability Insurance (of at least £5million)
    • Valid vessel survey report
    • MCA Code Certificate (or equivalent)
       
  2. to keep the Pontoon clean, tidy and clear of rubbish;
     
  3. not to use the Pontoon other than for the Permitted Use;
     
  4. not to moor any vessels on the Pontoon overnight;
     
  5. not to discharge any materials into the River Crouch;
     
  6. to ensure that any vessel used is seaworthy;
     
  7. to report any damage, waste or disrepair of the Pontoon to the Licensor within two working days;
     
  8. not to make any alteration or addition whatsoever to the Pontoon;
     
  9. not to display any advertisement, signboards, nameplate, inscription, flag, banner, placard, poster, signs or notices at the Pontoon without the prior written consent of the Licensor;
     
  10. not to do or permit to be done on the Pontoon anything which is illegal or which may be or become a nuisance (whether actionable or not), annoyance, inconvenience or disturbance to the Licensor or to the other users of the Pontoon or any owner or occupier of neighbouring property;
     
  11. not to cause or permit to be caused any damage to the Pontoon, or any property of the owners or occupiers of the Pontoon, or any neighbouring property;
     
  12. not to apply for any planning permission in respect of the Pontoon;
     
  13. not to do anything that will or might constitute a breach of any Necessary Consents affecting the Pontoon or which will or might vitiate in whole or in part any insurance effected by the Licensor in respect of the Pontoon;
     
  14. to observe any rules and regulations the Licensor makes and notifies to the Licensee from time to time governing the Licensee's use of the Pontoon;
     
  15. to leave the Pontoon in a clean and tidy condition;
     
  16. to indemnify the Licensor and keep the Licensor indemnified against all losses, claims, demands, actions, proceedings, damages, costs, expenses or other liability in any way arising from this licence and any breach of the Licensee's undertakings contained in these obligations;
