LOCALISM ACT 2011 Assets of Community Value - Notice of Sale

A Notice of Sale has been issued under the Localism Act 2011. Assets of Community Value.
The Queen Victoria Public House, The Street, Woodham Walter(“the Property”)
Notice is hereby given that Maldon District Council was notified on the 30 May 2022 that the owner of the Property intends to sell it. The Property was listed as an Asset of Community Value on the 30 June 2022.
A six week interim moratorium period has now been triggered and will end on the 11 August 2022. During the interim moratorium period, eligible community interest groups can submit a written request to be treated as a potential bidder to purchase the Property. An eligible community interest group is defined under regulation 12 of The Assets of Community Value (England) Regulations 2012.
Intentions to Bid must be received by 11 AUGUST 2022
If an Intention to Bid is received:
A full moratorium of 6 months will commence starting from the date on which the Council was notified of the intended sale of the Property. The full moratorium period will therefore end on the 30 December 2022.
During the 6 month full moratorium period, the owner may continue to market and negotiate sales, but may not exchange contracts or enter into a binding contract to exchange contracts to dispose of the Property at a later date. However, the owner may sell the Property to a community interest group during the full moratorium period.
If a sale to the community interest group which submitted the intention to bid is not agreed in the 6 month full moratorium period, then the owner is free to sell the Property within the 18 month protected period from the date that the Council received notification of the relevant disposal from the owner. The protected period will end on the 30 December 2023.
If no Intention to Bid is received:
The owner is free to proceed with the sale of the Property.
