How To View And Comment On A Planning Application

View

All applications are publicised by a notice displayed at or near the site. The first site notice will be yellow in colour and means that a new application has been submitted.

If an application is significantly changed we may need to re-advertise it and do so by erecting a blue site notice. You are advised at this stage to view the plans again to ensure that the changes made do not affect you in any way.

If you would like to comment on a planning application, this must be made in writing within 21 days of the advertisement of the application.

Comment

  • Via email: dc.planning@maldon.gov.uk
  • Write to us at: Planning Services, Maldon District Council, Princes Road, Maldon CM9 5DL

When making your comments please clearly state the planning application number and the site address of the proposed development on all correspondence.

The Council can only take into account comments received that relate to planning matters. For example, this might include:

  • any damage to the amenities of residents caused by noise, smell, loss of light and overlooking
  • the visual impact of the proposed development - what it will be like to look at, but not the loss of view
  • the effect of the proposal upon the enjoyment of your home or garden
  • on the appearance of the surrounding area and upon highway safety

The following examples would not be considered as planning matters by the Council:

  • loss of private view
  • loss of value to your property
  • loss of acquired rights to light
  • loss of private access rights
  • land ownership issues

Only planning matters will be reported to the relevant committee.

Public access to documents and information

Please note that the planning application and decision making process is open and transparent. The Council is required by law to make all comments received available for inspection by any members of the public, including the applicant.

If you do not wish to reveal personal information such as your written signature, personal telephone numbers or email addresses, these do not need to be provided. You must, however, state your name - this can be typewritten - and address. Confidential representations cannot be accepted.

The Council reserves the right not to publish or take into account any letters of representation which are openly offensive or defamatory. Adverse comments of a personal nature are in any case irrelevant to the determination of a planning application: the Council will only take into account material planning considerations, of which we give some examples above.

What happens next?

If you do comment on a planning application you will be notified of the Council's decision. Unfortunately, we cannot at present respond to requests to keep you directly informed of the progress of an application you have commented on. Please check our 'Track an Application' online service for progress.

Please note that the views expressed by individuals or organisations in comments made on planning applications do not necessarily represent the views of the Maldon District Council.
